These are the terms and conditions ('Conditions') under which we supply you with Services and Events Entry.
They describe the terms on which we will sell the services to you. In particular, we must deliver the correct events, at the agreed structure, time and place, and they explain our legal responsibility to you if we fail to meet these standards.
They also explain that you must pay us the correct price. These issues are essential for insurance and risk purposes. So we have also included a clause to explain the position if our services are delayed or cancelled for reasons outside anyone's control (including natural causes).

4.1 The Booking Form collects your initial interest in participating in one or multiple events organised by Chester Photo Festival.
4.2 The Booking Form collects your initial interest in receiving services from Chester Photo Festival.
4.3 The Booking Form may be adapted to collect relevant details on your interests. (For instance, a booking form for attending a conference may differ from one for participating in our bespoke sessions).
4.4 We may discuss your details via telephone, email or live chat (WhatsApp).
4.5 Completion and/or sending the Booking Form to us DOES NOT confirm your place.
4.6 Once the Booking Form is completed, it can be sent to us via our website or our email address events@chestephotofestval.com.
4.7 We will verify and confirm the final details of your booking order with you, followed by an invoice to be paid in full.
5.1 The Invoice serves as our offer to you for purchasing our services or participating in our events, per your instructions. It is essential to ensure that the invoice details, including your booking information, are accurate.
5.2 Your booking is considered complete only upon our written confirmation that the invoice has been paid in full. This confirmation will be sent from our email address: events@chestephotofestval.com.
5.3 Once the Invoice is paid in full, it constitutes our entire agreement. Any prior statements or representations we made do not form part of the agreement unless explicitly included in it in writing. This includes samples, drawings, advertising, catalogues and other promotional or descriptive materials.
5.4 The Invoice will include the following details: our contact information, your contact information, the amount to be paid via bank transfer, the name of the event, the date and location of the event and any additional details specific to your event as requested via the Booking Form.
5.5 The invoice may incorporate additional terms and conditions specific to your event.
6.1 The price of the event or activities you intend to participate in is specified in our acceptance of your booking.
6.2 You are required to pay our invoice in full within seven days of the invoice date. Failure to do so may result in the cancellation of your booking.
6.3 We have made every reasonable effort to ensure the accuracy of our prices. Prices will be verified when we process your booking.
6.4 Payment for our events and activities must be made in advance before the events can take place.
6.5 Our events, courses, competitions or other activities offered through our site may have additional terms and conditions you must agree to before participating. You must agree to these terms and conditions, for example, when completing the Booking Form and/or when receiving your invoice for payment.
6.6 IMPORTANT! We only accept payments for our invoices through the following method:
6.7 Do not provide your PIN number, Passcodes, passcodes, secret answers or any personal passwords. We will never ask for this type of information.
7.1 Our confirmation that your payment has been successfully processed will be sent to your email address in written form via our email address: events@chestephotofestval.com.
7.2 Our written confirmation that your invoice is paid in full will constitute our agreement.
7.3 Our written confirmation that your invoice is paid in full indicates that your booking order is complete.
7.4 The written confirmation will contain the booking details of your event or services as we previously agreed.
8.1 The Events and Services are described on our website in distinctive sections, including event details and participant-specific information.
8.2 We reserve the right to modify any of our specifications to comply with any regulations.
8.3 If we fail to deliver the Events and Services, our legal responsibility to you will be limited to the costs stated in your invoice.
8.4 If we refuse to deliver the Events and Services, you may consider our agreement terminated. We will reimburse you without undue delay.
9.1 We will not be legally responsible to you for any loss of profit or any loss which you allege arises as a consequence of our agreement with you, and our total legal responsibility to you under our agreement will not exceed the Price of the Events and Services.
9.2 Personal or group arrangements, including travel, accommodation or hospitality related to the event or services, are to be arranged by you at your own risk. Our liability to you is related to your participation in our event or receipt of our services and is limited to the price paid as stated in your invoice.
9.2 These Conditions do not limit our legal responsibility for death, personal injury caused by our unreasonable carelessness (known as negligence) or that of our employees, agents or sub-contractors, fraud, defective products under the piece of legislation known as the Consumer Protection Act 1987, or any other matter that the law says we can't exclude (for example under the Consumer Rights Act, 2015).
9.3 Neither of us will be legally responsible to the other for failure or delay in carrying out this contract, which is caused by an event beyond our reasonable control, which we could not have foreseen or which was unavoidable. This includes industrial disputes, energy or transport failures, acts of God, war, terrorism, civil unrest (such as riots), explosions, mechanical breakdown, natural disasters, deliberate damage, or being let down by suppliers or subcontractors.
9.4 We only supply events and services under our agreement, and we make no warranty or representation that they are suitable for commercial, business, or industrial use (including resale).
10.1 We do not guarantee the accuracy of material on our site, and any information is provided on an “as is basis”. As far as legally possible, we exclude legal responsibility for the following:
10.2 We cannot be held responsible for any amount greater than the submission fee you have paid for our events.
10.3 We are not liable for any damage, loss, or theft of your artwork(s). Each participant (artist) must ensure they have arranged their own insurance cover.
10.4 If you agree to provide your artwork for our events, you are solely responsible for its transport and insurance cover, and you must make separate arrangements for this.
10.5 If you agree to submit your own work to the festival, you confirm that you hold full copyright ownership of your submitted work.
10.5 We don't exclude legal responsibility for death or personal injury owing to our negligence, or legal responsibility for fraud or fraudulent misrepresentation, or for anything else where exclusion is not allowed by the law.
11.1 The material you submit will be considered non-confidential, and you will not retain ownership rights. This allows us to copy, distribute, and display your material to promote the exhibitions and activities of the Chester Photo Festival, including on our website and social media channels.
11.2 Participants' works may be publicly displayed and attributed to them for promoting the Chester Photo Festival's exhibitions and activities, including on our website and social media channels.
11.3 By submitting work to our events and activities, you declare that you are the sole and exclusive owner of all rights to the submitted material. You also confirm that you have obtained all necessary consents and permissions from any third parties involved in creating the work and that these consents have been fully granted and accepted.
11.4 You agree that we may disclose your identity to them if any third party claims ownership of the material or alleges that it infringes their rights.
11.5 We disclaim any legal responsibility for the accuracy of the material you upload to the site and reserve the right to remove it at our discretion if it does not comply with our acceptable use policy.
11.6 Intellectual Property Rights: By submitting your work, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the material. You keep ownership of your intellectual property rights but permit us to use your work under these terms.
11.7 Duration: The rights you grant under these terms are perpetual, meaning they continue indefinitely unless you withdraw your consent in writing, in which case we will cease using your material.
12.1 We will produce a print copy of the catalogue on demand only.
12.2 We do not hold copies in stock.
12.3 Payments are to be made in advance and are non-refundable once we have ordered your print.
12.4 We collect the orders and send them to the printer twice a month. They are delivered either on the 15th or 30th of each month.
12.5 Depending on the delivery destination, your printed copy (copies) should be with you from 2-3 days up to 2 weeks or more for USA and other International deliveries.
12.6 We cannot be responsible for delivery times or delays, but we will make every effort to ensure your copy (copies) are with you as promptly as possible.
12.7 We will deliver your printed copy (copies) via 1st Class Post services, accompanied by a tracking number.
12.8 We will keep evidence of the postage until the delivery is completed.
12.9 We cannot verify the correctness of the delivery address you offered. This lies entirely with you when sending the details to produce a print for you.
12.10 You will receive an invoice to be paid in advance, which will have the delivery address.
12.11 By paying the invoice, you agree to our terms and conditions, and you confirm that the delivery address is complete and correct.
12.12 For in-person collections by appointment, arrangements will need to be made on a designated collection day from our studio or one of our festival partners.
12.13 2025 Chester Photo Festival partners: Castlefield Gallery New Art Spaces, Picture House, Kingkabs Chester, University of Chester, Picturehouse Chester, Grosvenor Museum Chester, St John’s Church and St Werburgh’s Church.
12.14 Once you have filled out the pre-order form, we will reply within 24 hours with your invoice to be paid in advance, along with a date when we predict your print will be ready for delivery or collection in person.
12.15 We will only be able to process your printed copy order if payment has been completed.
12.16 Once we send your order to be printed, we cannot reverse the process, and your payment is non-refundable. We send the material to the printer twice a month to ensure it is ready for delivery on the 15th and 30th of each month.
13.1 We will deal with any personal data under our privacy policy and all applicable data protection and privacy legislation in force from time to time in the UK, including (i) the UK GDPR, (ii) the DPA 2018 (and regulations made thereunder); and (iii) all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data.
14.1 We are the owner or licensee of all intellectual property rights in the site (for example, the copyright and any rights in the designs and trademarks) and in any of the material posted on it. They are protected by copyright.
14.2 You can print copies and download extracts of any page on the site for your personal reference, but not for commercial use without our written licence. You must not alter anything or use any illustrations, video, audio or photographs separately from the text that goes with them.
14.3 If you share anything from our site, you must acknowledge that it is our content and we have rights over it.
14.4 If you breach these terms, you lose your right to use our site and must destroy or return any copies you have made.
15.1 If you do anything which is a criminal offence under a law called the Computer Misuse Act 1990, your right to use the site will end straightaway. We will report you to the relevant authorities and give them your identity.
15.2 Examples of computer misuse include introducing viruses, worms, Trojans and other technologically harmful or damaging material.
15.3 You mustn't try to get access to our site or server or any connected database or make any 'attack' on the site. We won't be legally responsible for any damage from viruses or other harmful material that you pick up via our site.
16.1 You are allowed to make a legal link to our website's homepage from your website if the content on your site meets the standards of our Acceptable Use Policy. We can end this permission at any time.
16.2 You mustn't suggest any endorsement by us or association with us unless we agree in writing.
17.1 Links from our Site Platform to other websites are for information only. We don't control them and don't accept responsibility for other websites or any materials found upon them or any loss you suffer from using them.
18.1 We change these terms from time to time and you must check them for changes because they are binding on you.

20.1 These terms and any dispute or claim relating to or connected with them (including non-contractual disputes or claims) shall be governed by and construed under the laws of England and Wales.
20.2 If any such dispute cannot be settled amicably through ordinary negotiations between the parties, or either or both is or are unwilling to engage in this process, either party may propose to the other in writing that structured negotiations be entered into with the assistance of a fully accredited mediator before resorting to litigation.
20.3 Any dispute shall not affect the parties' ongoing obligations under these terms.
20.4 The English courts have the only right to hear claims related to our site (and any non-contractual matters arising from these terms), and all disputes are governed by English law.
21.1 We are allowed to transfer our rights and responsibilities under these terms and conditions to someone else, for example, by assignment, a legal charge or sub-contracting our rights and obligations under this contract, but you may not do any of these things unless we have previously agreed in writing that you can.
21.2 Nobody other than you and us may rely on any terms of our agreement.
21.3 Changes to our agreement are only binding if we agree to them in writing, sign them and give you a copy.
21.4 We always welcome feedback from our customers. While we always use all reasonable endeavours to ensure that your customer experience is positive, we nevertheless want to hear from you if you have any cause for complaint.
21.5 If any such dispute cannot be settled amicably through ordinary negotiations between the Parties, or either or both is or are unwilling to engage in this process, either Party may propose to the other in writing that structured negotiations be entered into with the assistance of a fully accredited mediator before resorting to litigation.
21.6 This Contract and any dispute or claim relating to or connected with it (including non-contractual disputes or claims) shall be governed by and construed under the laws of England and Wales.
21.7 The courts of England and Wales are the only place where any disputes arising from it may be decided unless your rights as a consumer allow you to choose a court in a different jurisdiction.
